Public Profile Moderation Policy
The French version of this policy shall prevail in case of any discrepancy.
This policy sets out the rules applicable to content published by Professionals on their public profile accessible via the FitResa marketplace (fitresa.com/explorer). It supplements the General Terms of Service (ToS) and General Terms of Sale (GTS) of the platform.
1 — Purpose and scope
Any Professional who has enabled the visibility of their public profile on FitResa (from their account settings) agrees to comply with the rules set out in this policy. These rules apply to all content published on the profile: establishment name, description, photos (avatar and banner), course types, contact information and any other publicly visible field.
2 — Permitted content
- Accurate and verifiable information about the establishment (name, address, activities offered)
- Description of courses and services actually offered
- Genuine photos of the establishment or activities (with image rights)
- Valid professional contact details (phone, email, website, social media)
- Up-to-date pricing and schedules
- Verifiable professional certifications and qualifications
3 — Prohibited content
- False, misleading or deceptive information likely to mislead clients
- Offensive, defamatory, discriminatory, sexual or hateful content
- Photos not representing the establishment or used without rights (stolen images, third-party logos)
- Promotion of illegal products or services (unauthorised supplements, doping, etc.)
- Advertising for competing establishments or services
- Falsified contact details or impersonation of another establishment
- Fictitious reviews or testimonials featured in the description
- Content infringing third-party intellectual property rights
4 — Moderation process
All public profiles are subject to manual moderation by the FitResa team before publication or after substantial modification. FitResa reserves up to 5 business days to review each publication or modification request.
In the event of non-compliance, FitResa notifies the Professional by email specifying the items to be corrected. The Professional then has 7 calendar days to submit a corrected version. After this deadline without correction, the publication request is rejected.
FitResa may immediately unpublish content without prior notice in the event of manifestly unlawful content (hate speech, CSAM, incitement to violence, etc.), in accordance with its legal obligations.
5 — Reporting
Any user may report a profile they consider non-compliant with this policy by emailing legal@fitresa.com with the following information: URL of the profile concerned, nature of the issue, available evidence (screenshots, links).
FitResa undertakes to process each report within 10 business days and to notify the reporter of the outcome.
6 — Applicable sanctions
In the event of a breach of this policy, FitResa may apply the following measures, proportionate to the severity of the breach:
Warning: email notification of the breach with a request for correction within 7 days.
Temporary unpublication: suspension of profile visibility in the marketplace until non-compliant elements are corrected.
Permanent unpublication: permanent removal of the profile from the marketplace in the event of repeat offences or serious breaches.
Account termination: in the event of serious and repeated violations of the ToS or this policy, FitResa reserves the right to terminate the Professional's account in accordance with Article 8 of the GTS.
Sanctions involving temporary or permanent unpublication do not entitle the Professional to a refund of current subscriptions.
7 — Policy changes
FitResa reserves the right to modify this policy at any time to adapt to platform developments, usage patterns or legal requirements. Any material change will be notified to affected Professionals by email with a minimum of 15 days' notice. Continued use of the public profile after that date constitutes acceptance of the revised policy.
